Gonna Be Busy.

Got Court this week. Other other attorney in the office, my boss, Harris, is supposed to be trying a murder case this week. If there is time, they may be trying one of mine: either another murder or a lewd act on a minor. Then a week of no court, then another one-week term after that. Anyway, I'll try to check in.

Thanks, guys. Today was a total waste. New Grand Jury sworn. Petit Jury panel qualified. I had four people begging to plead guilty with deals worked out and no one would call their cases. One plea to a marijuana possession charge. Harris, I think, had one plea. A private attorney from out of town was, evidently, told to be there to plead one of his guys. He waited three hours and they didn't call his guy's case. There's a new administrative Solicitor, and he... well, the judge is pissed. There are a bunch of attorneys sitting around doing nothing. I was wrong about Harris's case: it's a kidnapping/armed robbery/burglary, but no murder. My cases (or, one of them) won't be until next term (two weeks from now), but I still have to be up there. It's painful.

Too bad you don't get paid by the hour. And they should just legalize marijuana. What a waste of our valuable court time and money prosecuting something like possession. Just legalize it and tax the hell out of it. We could do a lot with that money. Imagine the jobs that would be created.

I know what a Grand Jury is but what is a "Petit Jury"(are they teenage girls or munchkins?). And I am serious. I don't know.

And jrt, you are so right about legalizing marijuana except for the taxing part. Excise taxes should cover the cost of the problems caused by the product. That's why gas taxes fund road repair.

If you legalize marijuana and then tax the hell of it to fund general spending (schools, healthcare), your revenue is dependent on pot smokers (a shifty bunch at that).

If you get the benefit from increased public spending, why shouldn't you be the one who pays for it?

Tam and John, I agree that pot probably ought to be legal, but it's not. Taxes are a tricky subject. I actually argued a case on taxes versus fees and federal court jurisdiction. If you need a sleep aid, check this out. Come to think of it, you may not be able to access this site. Anyway, the case name is: Collins Holding Corp. v. Jasper County, 181 F.3d 87
(4th Cir. Ct. App 1999). What I do now is a lot more interesting. Court was good today. Might post something later.

That site concisely explains the difference between a tax and a fee (and also the attempts pols make to blur the differences to suit their ends).
